🌿 Specific Use Permit

SUP23-07 for 121 S. Main St. requested by Blue Sky Buds LL, d/b/a BRIXX Cultivation to allow a medical marijuana dispensary at the property.

Public Hearing
City staff informed Planning Commissioners that the business is currently operating a few buildings south at 135 S. Main St.

Josh Wilson with BRIXX told Commission Chair, Jana Philips, they plan to move the dispensary to the new location. City staff helped Commissioners clarify that a new specific use permit application is required any time the ownership or the location of the dispensary is changed.

Actions
Commissioner Williams motioned to approve the application. Commissioners agreed with a vote of 4-0.

📍 Map Amendments

MA24-13 for 701 W. Highpoint Drive requested by Jason Johnson to allow the existing apartment complex to be converted into condominiums.

Public Hearing
Stephen Gose with Gose & Associates representing the applicant told Commissioners that the intent of the developer is to have unit ownership. Therefore, rezoning the property from Commercial General to Commercial Business was needed to allow the conversion.

No one spoke in favor or against the map amendment. 

Actions
Commissioner Mark Prather motioned for the City Council to approve the map amendment. Commissioners agreed with a vote of 4-0.

MA24-14 for 3118-3124 E. 4th Ave. requested by Pioneer Investment Group, LLC to rezone the property from Small Lot Single-Family to Two-Family and Multi-Family district.

Public Hearing
City staff told the Commission the applicant wishes to build two, 2-story duplex structures with parking access off S. Mockingbird Lane. The property is near Small Lot Single Family, Two-Family, and Multi-Family zoning. The applicant did not attend the meeting. 

Ashley Hernandez Torres, who lives near the proposed development, shared her concerns about where the parking would be faced and who would be responsible for any damage to personal vehicles during the construction process. Torres was hoping the applicant would be at the meeting so she could have learned more about the plans.

City staff informed her any damages would be a civil matter between her and the developer and construction crews would need to obey the City’s disturbing the peace ordinance to only work during certain hours unless they filed for an exception. Staff couldn’t speak to the parking layout.

Actions
Commissioner Prather motioned to table the discussion on the map amendment to the Dec. 17, 2024, public hearing. Commissioners agreed with a vote of 4-0.

🏘️ Short Term Rental Applications

STR-182 for 811 N. Star Drive & STR-183 for 801 N. Star Drive requested by Timothy Morenc.

Public Hearing
The applicant for both properties did not attend the hearing. No one spoke in favor or against the application.

Actions
Planning Commissioner Riley Williams motioned to defer to the next hearing on Dec. 17, 2024. Commissioners agreed with a vote of 4-0.
